Rental Terms and Conditions

I. Basic Provisions

1. The contract for the lease of movable property is concluded pursuant to Section 2201 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended

(hereinafter referred to as the "Lessor")  

2. These Operating Rules regulate the mutual rights and obligations of the Lessor and the natural person who concludes a contract for the rental of movable property (hereinafter referred to as the "Lessee") via the web interface located on the website available at tlamagames.com and in person at the Lessor's premises (hereinafter referred to as the "Rental Shop").

II. Ownership

2.1 The Lessor is the owner of the movable property ("Games") of the Rental.

2.2 The Lessor rents the Games under this Agreement in accordance with the Lessee's order.

III. Rental period

3.1 The Games are rented for a period of one week. The rental period starts at the moment of ordering via the website of the operator or by carrying out the rental at the premises of the lessor without prior online order. The rental period ends at the end of one week after the order. Should this date fall outside the opening hours of the establishment, the loan period expires at the moment of the previous end of the opening hours of the establishment.

3.2 Extension of the contract is possible before the end of the agreed period by mutual agreement. Extension of the loan period is not automatic and is not enforceable. A loan period longer than 1 week can be agreed upon.

3.3 If the hirer fails to return the borrowed games on time, he will be charged a penalty of CZK 50 for each day of delay (in addition to the amount for the weekly borrowing).

IV. Deposit and rental fee

4.1 Before renting a game, the renter is obliged to pay a deposit of the recommended price of the game. This deposit may be paid at the premises either in cash or by card block (pre-authorisation).

4.2 The rental fee for one week for each game is 10% of the recommended retail price. The rental fee will be deducted from the deposit paid when the game is returned.

4.3 If the game is returned in less time than agreed, the lessor is still entitled to the full rental fee.

4.3 If the game is damaged or destroyed in the course of the rental without the lessor's fault (not as a result of normal wear and tear), the lessee is obliged to pay for the damage caused in the amount of at least CZK 100. In the event of loss or damage that does not allow normal use of the game, the lessee shall pay the full price of the game or the cost of reinstallation if the game is no longer normally available. This amount will be deducted from the deposit.

4.4 The hirer is obliged to return the hired games to the hire company.

V. Rights and obligations of the hirer

5.1 The hirer is fully responsible for the hired game, is obliged to take care of it so that it is not damaged or destroyed, and to keep it clean and dry.

5.2 The hirer shall not make any alterations to the game which may devalue the game or any part thereof without the consent of the hirer.

5.3 The Hirer hires all Games at his own risk and the Lessor shall not be liable for any damage to the health or property of the Hirer or third parties caused in connection with the use of the hired Games.

5.4 The hirer is obliged to return the borrowed game within the agreed time.

VI. Rights and obligations of the renter

6.1 The lessor is obliged to inspect the game before handing it over to the lessee.

6.2 The lessor is obliged to hand over the game to the lessee in a condition suitable for use.

6.3 The lessor has a duty to inspect the game on its return.

VII. Customer account

7.1 The rental of games is subject to the creation of a customer account on the operator's website. This account is identical to the online shop account. This account is subject to Article IV. of the Terms and Conditions.

7.2 The renter agrees to the processing of personal data for the renter's needs in accordance with the applicable GDPR regulations.

7.3 The Lessor has the right to verify the identity of the Lessee before the first borrowing of the Lessee by means of a valid personal document of the Lessee.

 

These Operating Regulations shall come into force on 1 August 2019.
